A HOLSWORTHY man has been sentenced to four years imprisonment after being found guilty of child sex offences.

Daniel Snell, 35, of Kingdon Way in Holsworthy was sentenced at Truro Crown Court.

He was found guilty of two counts of performing sexual activity on a child.

A third charge relating to committing sexual activity with a child was ‘left on file’.

A "left on file" or " lie on file " charge means the prosecution stops proceeding with a criminal charge without formally acquitting the defendant or closing the case permanently.

It occurs when a presiding judge agrees that there is enough evidence for a case to be made and does not involve an admission of the charge being made by a defendant but remains on their record.

It is sometimes used when there are multiple charges, in the interests of public interest – where it is applied when pursuing every single count is no longer deemed necessary in the public interest or in the case of administrative efficiency to save the court time while keeping an option open if circumstances change.

Mr Snell has also been instructed to sign the sexual offender register, with him remaining on it for life.

He has also been given a five year restraining order by Truro Crown Court.

A spokesperson for Truro Crown Court confirmed that at a hearing on Friday, September 4, Mr Daniel Snell was sentenced. They said: “He was sentenced to four years imprisonment after being found guilty of two counts of sexual activity with a child. The third count, also relating to sexual activity with a child was ordered to lie on file.

“He was also ordered to sign the sex offenders register for life and there is a restraining order put in place on him for five years.”
